RADHAKRISHNAN AND THE HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT APPEAL No.1551 OF 2018 JUDGMENT: (ORAL) (Per the Hon'ble Sri Justice Thottathil B.Radhakrishnan) Heard learned counsel for the appellant-writ petitioner in this appeal against the refusal to grant an interim order pending writ petition.
2. The writ petitioner, who was a watchman in a maternity hospital, was issued relieving order dated 30.09.2018 on the premise that he has attained the age of superannuation. His plea is that he is entitled to work till 2023. The learned single Judge has felt through the impugned interim order that the issue sought for cannot be considered and no interim order can be granted unless the writ petition is heard and decided. Thus, the learned single Judge refused to grant interim order against the relieving order dated 30.09.2018.
3. At this distance of time, we do not deem it appropriate to pass any order contradicting the impugned interlocutory order passed by the learned single Judge in the writ petition. Hence, preserving all contentions in the writ petition, this writ appeal is dismissed. It is open to the appellant-writ petitioner to request the learned single Judge for expeditious disposal of the writ petition; which request may be sympathetically considered by the learned single Judge. No order as to costs.
