ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioners/A2 and A3 seeking to quash the proceedings in C.C.No.473 of 2011 on the file of Judicial First Class Magistrate at Godavarikhani, registered for the offence punishable under Section 498-A IPC and under Section 4 of Dowry Prohibition Act, against them.
2. It is alleged in the charge sheet that A1, at the instigation of A2 and A3, used to harass his wife i.e., de facto complainant, mentally and physically by demanding additional dowry of Rs.5 lakhs and finally, they necked her out from the matrimonial house. Based on the complaint, a case in Cr.No.191 of 2011 under Sections 498-A, 452, 506 IPC and under Section 4 of Dowry Prohibition Act, was registered against the accused.
3. Since there are serious allegations in the charge sheet, the matter has to be decided after full fledged trial and therefore, this Court is not inclined to interfere with the impugned proceedings.
4. At this stage, learned counsel for the petitioners confined his argument to the extent that the presence of petitioners/A2 and A3 may be dispensed with.
5. Considering the said facts and circumstances of
the case, the presence of petitioners/A2 and A3 before the trial Court is dispensed with except on the dates whenever their presence is insisted by the trial Court and they shall be represented by their counsel.
6. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
