THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition no.42254 of 2018 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking a writ of Mandamus declaring the action of the 3rd respondent in not receiving and processing the application of the petitioner for renewal of fitness certificate for vehicle bearing registration no.TS 15 UA 3028 as illegal, arbitrary and unconstitutional. A consequential direction to the 3rd respondent to receive the application, process and renew the fitness certificate related to the said vehicle of the petitioner is also sought in the writ petition. At the hearing, learned counsel for the petitioner and learned Government Pleader for Transport (TG) appearing for the respondents made a joint representation that the issue involved in this writ petition is squarely covered by the order, dated 25.10.2018, of this Court in WP.No.

38379 of 2018. A copy of the said order is placed on record. Having regard to the submissions and for the reasons alike as were mentioned in the afore-said order of this Court in the above mentioned writ petition, this Writ Petition is also disposed of in terms of the said order.
