HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 42401 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in trying to lay the road through the landed property of the petitioners situated in approved layout bearing L.P.No.712/ 1970 in R.S.Nos.194/ 1, 194/ 1B, 195/ 2 and 196/ 1 of Pidimgoyyi in Rajamahendravaram Municipal Corporation, East Godavari District, as illegal and arbitrary.

2) At the time when the matter is taken up for hearing, it is brought to the notice of the Court by the learned Standing Counsel for the second respondent-Corporation that the Corporation is not laying road through the land of the petitioners, but however the learned counsel for the petitioners would submit that in case if the land of the petitioners is sought to be used for laying the road, the authorities may be directed to follow the due process of law.

3) In view of the submission made by the both the counsel, any action taken by the authorities in respect of the land of the petitioners referred to above shall be in accordance with law and in case the authorities intend to lay the road through the land of the petitioners, they will follow due process of law.

4) With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. _________________________ JUSTICE C. PRAVEEN KUMAR 28.11.2018 gkv
