THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1843 OF 2016 ORDER:
This Criminal Petition is filed by the petitioner-accused No.1 under Section 482 Cr.P.C. seeking to relax the conditions imposed by the VII Additional Metropolitan Sessions Judge, Hyderabad, vide order, dated 05.01.2016, in Crl.MP. No. 3993 of 2015 in Crime No.240 of 2015 of CCS, DD Police Station, Hyderabad. Heard and perused the material available on record. While grating bail to the petitioner in the above Crl.M.P., the learned Sessions Judge, imposed the following conditions on the petitioner:
"1. the petitioner shall attend before the concerned SHO, CCS, DD, P.S., Hyderabad, twice in a week i.e. on every Sunday and Wednesday in between 9.00 a.m., and 5.00 p.m., till charge sheet is filed and
2. that he shall not leave the Hyderabad City limits without prior permission of the concerned S.H.O., and
3. that he shall also surrender his passport, if any." Learned counsel for the petitioner submitted that the petitioner is complying with the conditions imposed by the Court below and he is a private employee and therefore, it has become very difficult for him to attend before the SHO concerned, twice in a week and he is unable to move to his native place Mahabubnagar and hence, he requested to relax the conditions 1 and 2.
Considering the submissions of the learned counsel for the petitioner, this Court is inclined to relax the conditions 1 and 2, imposed on the petitioner.
Accordingly, the Criminal Petition is allowed and the conditions 1 and 2 i.e., the petitioner shall attend before the concerned SHO,
CCS, DD, P.S., Hyderabad, twice in a week i.e. on every Sunday and Wednesday in between 9.00 a.m., and 5.00 p.m., till charge sheet is filed and that he shall not leave the Hyderabad City limits without prior permission of the concerned S.H.O., imposed on the petitioner by the VII Additional Metropolitan Sessions Judge, Hyderabad, vide order, dated 05.01.2016, in Crl.M.P. No.3993 of 2015 in Crime No.240 of 2015 of CCS, DD Police Station, Hyderabad, are relaxed.
