HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.42436 of 2018 ORDER:

1) The present writ petition came to be filed seeking to declare the action of the respondents 2 and 3, in issuing the " Shortfall Intimation Letter" in File No.3006/ 15126/ W9/ 2018, dated 28.10.2018 and for not considering the application dated 16.10.2018, submitted by the petitioners for grant of building permission, as illegal and arbitrary. 2) When the matter is taken up for hearing, the learned counsel for the petitioners submits that the issue raised in the present writ petition, is covered by the order dated 5.12.2014, passed by this Court in W.P.No.37487 of 2014, and prays to dispose of the same in terms of the above said order. 3) Having regard to the above, the writ petition is allowed setting aside the impugned endorsement dated 28.10.2018.

Within four weeks from the date on which, the petitioners resubmit their application for building permission, the respondents 2 and 3 shall consider the same in accordance with law, including the provisions of the Greater Hyderabad Municipal Corporation Act, 1955 and the Rules and Bye-laws made therein, take a decision thereupon and communicate the same to the petitioners.

4) There shall be no order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
