HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.36725 of 2017 ORDER:

This Writ Petition is filed for a Mandamus to declare the action of the respondents in commencing the road widening works without following due process of law and without paying compensation to the petitioner as per the Right to Fair Compensation and Transparency in Land Acquisition and Resettlement Act, 2013, as illegal and contrary to law, and to direct the respondents to pay compensation to the petitioner, in lieu of the land acquired, as per the said Act. In the affidavit and also in the additional affidavit, filed in support of the Writ Petition, it is stated that the petitioner-firm was allotted Plot No.1 admeasuring 2,335 square yards in Survey No.473 of Gunadala, Vijayawada, for the purpose of setting up an industry for Repairing and Servicing of Trucks and Vehicles in the year 1976 and Plot No.2 was allotted to the petitioner in the year 1980 and that both the said Plots are situated in LP.No.49/84, VGTUDA, Phase-III, Jawahar Auto Nagar, Vijayawada. The respondents are trying to widen the road passing through the said lands of the petitioner without

following due process of law. Aggrieved by the same, the present Writ Petition is filed.

Heard learned counsel for the petitioner and Mr. T.S.Venkata Ramana, learned Standing Counsel for Vijayawada Municipal Corporation and perused the record. Mr. T.S.Venkata Ramana, learned Standing Counsel for Vijayawada Municipal Corporation, submitted that the respondent-authorities will follow due process of law. In view of the above submission of the learned Standing Counsel, the Writ Petition is disposed of with direction to the respondents not to evict the petitioner-firm from the subject lands without following due process of law. No costs. As a sequel, the Miscellaneous Petitions, if any, pending shall stand disposed of.
