HON'BLE SRI JUSTICE S.V.BHATT W.P.No.45245 OF 2016 ORDER:

The petitioner challenges notice dated 09-12-2016 issued under Sections 96 to 98 and 144 of A.P.Panchayat Raj Act, 1994 (for short 'the Act'). The petitioner is not complaining or challenging the notice on the ground of jurisdiction.

The case of petitioner is that a few tentative findings are recorded terming the communication as notice. The Panchayat Secretary-2nd respondent is trying to exercise his power under the Act. He attributes motives as well.

I have perused the notice dated 09-12-2016 and also the reasons prefaced for issuing the notice.

I am of the view that the petitioner has to give explanation, if circumstances demand, ask for opportunity of hearing to prove his case and enable the 2nd respondent to pass an order. The invocation of writ remedy at this stage of the matter, in my considered view, is misconceived.

The writ petition fails and is accordingly dismissed. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any pending, also stand disposed of.
