The criminal petition is disposed of before admission by giving liberty to the petitioner to appear before the learned Magistrate and file application for recall of the warrant, for the learned Magistrate to consider by obtaining bond for his future due appearance as contemplated by Section 88/89 Cr.P.C. subject to penalty of Rs.10,000/- (Rupees ten thousand only) payable to the Army Welfare Fund.

Miscellaneous petitions pending, if any, in the criminal petition shall stand closed.
