HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 18586 of 2016 ORDER:
Heard Sri M.A.K.Mukheed, learned counsel for the petitioner, Government Pleader for Municipal Administration and Urban Development and Sri V.Narasimha Gowd, learned standing Counsel for respondent Nos.2 and 3. With the consent of all the parties, the present writ petition is taken up for disposal at the admission stage itself.
There is no necessity to put the unofficial respondents on notice as this Court is not venturing to adjudicate the issue on merits.
The present writ petition is filed with the following prayer: "Issue a writ of mandamus declaring the action of the official respondents in not canceling the layout issued in LP No.101673/LO/PLG/HMDA/2013, dated 09.04.2015 against the tentative layout permit No.35/LO/PLG/HMDA/2015 in Survey Nos.368 and 369, Keesara Village and Mandal, Ranga Reddy District, pursuant to the petitioner's representation dated 12.04.2016, as illegal, arbitrary and in violation of Articles 14, 21 and 300-A of the Constitution of India;
and consequently direct the official respondents to cancel the same."
Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the second respondent to dispose of the representation dated 12.04.2016 made by the petitioner, at the earliest.
Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of directing the second respondent to dispose of the representation dated 12.04.2016 made by the petitioner for canceling the layout laid by the un-official respondents, in accordance with law, as expeditiously as possible, preferably within a period of four (04) weeks from the date of receipt of a copy of the order. It is needless to mention that the second respondent shall hear the petitioner as well as the un-official respondents before disposal of the said representation. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
