Kota Rajeswari And Another v. Vogeti Varalakshmi And 5 Others
THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CRP No.6316 of 2017 ORDER::
This civil revision petition is filed aggrieved by the action of the Court below in adjourning the suit OS No.150 of 2014 from 05-07-2017 to 23-01-2018 for further evidence and cross examination of PW1.
2.
The only submission made by learned counsel for the petitioners who are the defendants in the suit, which is filed for partition of the suit schedule property, is that the petitioners are at the advanced age of their life and, therefore, the Court below ought not to have adjourned the matter to such a longer date. On the other hand, learned counsel for the respondents submits that since the suit is of the year 2014 and the Courts are now concentrating on the cases of pre-2012, no exception can be taken to such an adjournment granted by the Court below.
3.
It is to be seen that petitioners are aged 83 and 66 years respectively and even otherwise, in cases where senior citizens are parties, such of those cases have to be given priority in disposal. Having regard to the facts and circumstances of the case, the Court below is directed to dispose of the suit OS No.150 of 2014 as early as possible, in accordance with law, preferably within a period of eight months from the date of receipt of a copy of this order. 4.
With the above directions, the civil revision petition is disposed of. Miscellaneous petitions, if any pending shall stand closed. No order as to costs.
