SHYAM PRASAD WRIT PETITION No. 44652 of 2016 ORDER: (Per VRS,J) The petitioner has come up with the above writ petition, seeking a Mandamus to direct the 2nd respondent-Bank to give her an opportunity to make payment of the entire amount due, within 60 days from the date of the auction.

As a matter of fact, the date of the auction notice is 21.11.2016. The date of the auction is 27.12.2016. A period of one month has already elapsed from the date of the auction notice. This is one of the several writ petitions either filed by the borrower or by the guarantor. Therefore, the appropriate remedy for the petitioner is to go before the Debts Recovery Tribunal.
