The Superintendent Of Police, v. Sri. D. Narsimlu,
THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.35095 of 2017 24.10.2017 Between:
The Superintendent of Police, Wanaparthy District and others ..Petitioners and D.Narsimlu ..Respondent Counsel for the petitioners: Government Pleader for Services (T.S.). Counsel for the respondent: -- The Court made the following:
CVNR,J & KVL,J W.P.No.35095 of 2017 24.10.2017 ORDER: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for a Certiorari to quash order, dated 26.11.2013, in O.A.No.774 of 2011 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short 'the Tribunal'). 2.
By the aforementioned order, the Tribunal has held that the penalty of postponement of increments for two years with effect on future increments and treating the period of absence from 23.12.2000 to 08.05.2001 as leave without pay is disproportionate to the gravity of the charges held proved against the respondent and accordingly, substituted the penalty with postponement of increment for one year without cumulative effect and with a further direction to treat the absence period from 23.12.2000 to 08.05.2001 as 'on duty' for the purpose of increments, seniority and pensionary benefits. 3.
The impugned order of the Tribunal was passed as far back as 26.11.2013. Nearly four years thereafter, this writ petition is filed questioning the said order. No explanation worth considering has been offered by the petitioners for the inordinate delay in filing the writ petition. As the petitioners failed to show any diligence in pursuing their cause, we are not inclined to entertain this writ petition only for the reason of laches and unexplained delay. 4.
Hence, the Writ Petition is dismissed.
5.
As a sequel to dismissal of the writ petition, W.P.M.P.No.43605 of 2017 filed by the petitioners for interim relief shall stand dismissed as infructuous. __________________________ C.V.NAGARJUNA REDDY, J _____________________________ KONGARA VIJAYA LAKSHMI, J 24th October, 2017 GHN
