THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2333 of 2016 ORDER:

This criminal petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioner-Accused No.1 seeking to quash the proceedings in FIR No.107 of 2016 on the file of Penamaluru Police Station, Vijayawada, Krishna District, registered for the offences punishable under Sections 420, 467 and 471 r/w.34 IPC. Heard and perused the material available on record. The allegations against the petitioner are that he created documents showing that the de facto complainant sold the property to him by forging the signatures of the de facto complainant. The de facto complainant also filed a civil suit against the petitioner and others. The truth or otherwise of the above offences can be ascertained during investigation of the case. Hence, this Court is not inclined to quash the proceedings against the petitioner.

The Criminal Petition is dismissed accordingly. Miscellaneous petitions pending if any, shall stand closed. ______________ RAJA ELANGO, J February 25, 2016.
