THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT PETITION No. 38192 OF 2017 ORDER: (Per VRS,J) The State of Andhra Pradesh has come up with the above writ petition challenging an order passed by the Andhra Pradesh Administrative Tribunal (for short 'the Tribunal'), directed them to conclude the disciplinary proceedings initiated against the respondent herein, within a period of six weeks.

Heard the learned Government Pleader for Services (Andhra Pradesh) and Mr.P.V.Ramana, learned counsel appearing for the respondent.

The respondent filed an original application before the Tribunal challenging a charge memo. The Tribunal rightly rejected the challenge but directed the department to complete the enquiry and pass final orders within six weeks.

Such an order should not have been assailed by the State Government, since it is in the interest of the department itself that disciplinary proceedings initiated against the erring employee, shall complete within a timespan.

Be that as it may, when the above writ petition came up for admission, we passed an order on 14.11.2017 to the following effect:

VRS,J & MGR,,J WP No. 38192 of 2017 "Mr. P.V.Ramana, learned counsel takes notice for the respondent.

Whoever is the authority among the writ petitioners 2 to 4 and who is competent to pass final orders in the disciplinary proceedings against the respondent, shall pass final orders without waiting the nod from the State Government within two weeks and place it before this Court on 28.11.2017.

Post for orders on 28.11.2017."

Pursuant to the said order, the Government have issued final orders dated 24.11.2017, imposing a penalty of withholding of one annual grade increment with cumulative effect upon the respondent herein. Therefore, nothing survives for adjudication in this writ petition.

Hence, the Writ Petition is closed. It will be open to the respondent to challenge the order of penalty in a manner known to law. No order as to costs.

Consequently, miscellaneous petitions if any pending in the writ petition shall stand closed.
