HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.243 of 2016 ORDER:

This petition is filed to withdraw O.P.No.2142 of 2015 from Additional Family Court, Malkajgiri, Cyberabad, to any competent Court at Hyderabad or Ranga Reddy.

2. Husband filed this petition and according to his affidavit, acts of the Presiding Officer indicated that he is showing bias against petitioner as the Family Court is reluctant to hear him or atleast note his presence when he appeared by coming all the way from U.S. in obedience of the directions of the Additional Family Court, Malkajgiri. The main grievance of petitioner is that his presence was not recorded and his statement was not recorded when he appeared on 04.04.2016. While ordering notice this Court has called for the remarks of the Presiding Officer and the Presiding Officer has submitted his remarks denying all the allegations. This Court also directed petitioner to take personal notice to respondent through registered post with acknowledgment and file proof of service. In compliance of the same, a memo is filed on 28.04.2016 along with postal acknowledgments showing that notice was served on respondent. In spite of service of notice respondent neither appeared in person nor through any advocate.

3. Heard arguments.

4. Considering the reasons stated in the affidavit filed in support of petition and also considering the remarks of

the Presiding Officer, O.P.No.2142 of 2015 is withdrawn from Additional Family Court, Malkajgiri, Cyberabad, and transferred to Family Court, Ranga Reddy at L.B.Nagar, for disposal in accordance with law.

5. Accordingly, this transfer C.M.P. is ordered.

6. Miscellaneous petitions pending, if any, shall stand closed.
