THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.12517 OF 2018 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused for grant of bail in Crime No.103 of 2018 of Jeelugumilli Police Station, West Godavari District, registered for the offences punishable under Sections 376 read with 511 of IPC.

Heard the learned counsel for the petitioner/accused and the learned Additional Public Prosecutor representing the respondent-State and perused the record.

As per the report lodged with the police, on 06.08.2018 at 12.00 noon, when the de facto complainant went to the house of one Nagamani and while she was bringing water in a bucket, the petitioner/accused caught hold of her from back side, forcibly took away her into the room of the said house and made an attempt to commit sexual assault on her. When she made hue and cry, the husband of the de facto complainant and other persons-K.Ramu, K.Dilip and K.Subbarao came there. On seeing them, the petitioner/accused fled away from the scene of offence. In the course of investigation, four persons were examined. All of them have stated the commission of alleged offence by the petitioner/accused. The allegations are grave and specific against the petitioner/accused. The punishment for the alleged offences is stringent. Release of the petitioner under Section 438 Cr.P.C. would hinder the investigation. There is possibility of threatening the witnesses. There are no justifiable grounds to allow the petition.
