THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR AND THE HON'BLE SRI JUSTICE N.BALAYOGI C.M.A. No.1199 OF 2017 JUDGMENT: (per Hon'ble Sri Justice C.Praveen Kumar) 1) The present appeal came to be filed under Order 43 Rule 1 CPC, assailing the order dated 15.06.2017, passed in I.A.No.405 of 2015 in O.S.No.43 of 2015 on the file of Family Court Judge cum VIII Additional Sessions Judge, Mahabubnagar, wherein an application filed by the plaintiff/respondent No.1 herein seeking injunction was allowed.

2) Though various grounds are raised, learned counsel for the petitioner/defendants would contend that having regard to the facts in issue and since the defendants are the aggrieved persons, he requests the Court to give a direction to the trial Court to dispose of the suit within six (06) months which is not opposed by the learned counsel for the respondents. 3) Having regard to the fact that respondent No.1/plaintiff is aged about 68 years and he is a senior citizen, we direct the trial Court to dispose of the main suit itself, as expeditiously as possible.

4) Accordingly, the appeal is disposed of. There shall be no order as to costs.

5) Miscellaneous petitions, if any, pending, shall stand closed.
