THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38218 of 2016 ORDER:

This writ petition is filed seeking to declare the registration of FIR No.50 of 2016, as illegal and arbitrary.

Heard and perused the material available on record. The case of the petitioner is that the 4th respondent lodged the present complaint against the petitioner alleging that the petitioner has deterred him from doing his official duties on the date of the Ganesh Idol immersion on 07.09.2016 when the 4th respondent along with another police constable were performing their duties. The main grievance of the petitioner is that the 3rd respondent is proceeding basing on the false and frivolous complaint made by the 4th respondent without any proper reason and if the petitioner is arrested, he would be put to irreparable loss and deprivation of his right.

Considering the grievance of the petitioner, the 3rd respondent is directed to complete the investigation in FIR No.50 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. The petitioner is directed to report before the 3rd respondent daily at 7.00 p.m. from 17.11.2016 to 24.11.2016. The petitioner is further directed to execute a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety to the satisfaction of the 3rd respondent as surety for his future appearance as and when required for the purpose of investigation. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 8th November, 2016 KL
