THE HON'BLE SRI JUSTICE SANJAY KUMAR Writ Petition No.43013 OF 2018 ORDER:

This Writ Petition was filed aggrieved by the alleged inaction of the authorities upon the representations dated 16.07.2018, 30.07.2018, 06.09.2018 and 10.09.2018 made by the petitioner. By way of the said representations, the petitioner sought an inquiry to be instituted against the Sarpanch of Reddy Pally village, Medak district, the 5th respondent, with regard to the utilization of funds.

Though the 5th respondent is stated to have been served, Sri Rajagopallanvan Tayi, learned counsel for the petitioner, has not yet placed on record the postal tracking report in proof thereof. However, in the light of the order proposed to be passed by this court, without any independent adjudication on merits, it would be unnecessary to keep the matter pending for the appearance of the 5th respondent.

Learned Government pleader for Panchayat Raj and Rural Development, State of Telangana, would inform this court that the District Panchayat Officer, Medak District addressed a brief note to her on the subject case, wherein he stated that the records of the Sarpanch were not found to be in order and upon consideration of the explanation submitted by the Sarpanch and the Panchayat Secretary of Reddy Pally gram panchayat, he was not satisfied and issued charge memo-cum-recovery show cause notice dated 26.11.2018. It appears that the District Panchayat Officer, Medak District proposes to recover a sum of Rs.6,94,812/- thereunder.

In the light of these developments, it is clear that the alleged inaction attributed to the authorities is without basis. The cause in the Writ Petition therefore does not survive for consideration and the Writ Petition is accordingly closed.

Miscellaneous petitions pending in this Writ Petition, if any, shall also stand closed in the light of this final order. No order as to costs.
