THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.35343 of 2017 ORDER:
In this writ petition, under Article 226 of the Constitution of India, the only grievance of the petitioner is that when the respondents 4 and 5 are making illegal constructions in his neighbouring property, viz., premises bearing No.1-6-769 admeasuring 127.5 square yards situated at Pathan Basthi, Zamistanpur, Hyderabad, and when a representation, dated 29.09.2017, was given to the official respondents, no action is being taken. At the hearing, learned counsel for the petitioner submits that if a direction is given to the official respondents to consider and dispose of the representation, the grievance of the petitioner would be redressed. Learned Standing Counsel appearing for the respondents 1 to 3 would submit that the representation lacks in material details and that a fresh representation is required to be given.
In the facts and circumstances, this Court is of the considered view that this writ petition can be disposed of with appropriate directions. Accordingly, the Writ Petition is disposed of directing the respondents 1 to 3 to consider and dispose of the representation, dated 29.09.2017, of the petitioner in strict accordance with the procedure established by law, within three weeks from the date of receipt of a copy of this order and communicate the decision taken thereon to the petitioner within a week thereafter. There shall be no order as to costs.
