THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.9024 of 2002 ORDER:

This Writ Petition is filed seeking the following relief: " .. to issue a writ order or direction, more particularly, a Writ of Mandamus declaring the action of the respondents in not considering my case for recruitment to the post of Junior Executive (E&M)(E-1) pursuant to the terms of settlement dated 10.9.2001 as illegal, unjust, arbitrary and contrary to the terms of the settlement and issue a consequential direction directing the respondents to consider the case of the petitioner for recruitment to the post of Junior Executive (E&M) in the Respondent No.1company or in the alternative direct the respondents to identify the number of vacancies for Mechanical Diploma holders in Junior Executive (E&M) E-1 Grade and promote both Diploma (E&M) Holders by considering the date of joining and consequently promote such mechanical diploma holders who have joined in 1986 to the post of Jr. Executive (E&M) E-1 Grade and pass such further order or orders as this Hon'ble court deems just and proper in the circumstances of the case."

When the matter is taken up for hearing, learned standing counsel for the respondents submitted that the petitioner is not having requisite qualification to the post of Junior Executive (E&M) (E-1) and, therefore, he is not entitled for recruitment to the post of Junior Executive (E&M) (E-1).

In view of the above submission, the Writ Petition is dismissed. No order as to costs.
