HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36518 of 2016 ORDER:
This writ petition is filed seeking a direction to the 3rd respondent not to interfere with peaceful possession and enjoyment of land admeasuring Acs.45.01 guntas by the petitioner and also not to assist and not to support the respondents 4 to 6 in grabbing the petitioner's land, and consequently, direct the 3rd respondent to take action against the respondents 4 to 6.
Heard and perused the material available on record. The case of the petitioner is that it is company, involved in real estate, trading and development and it purchased the subject land under a registered sale deed from the respondents 4 to 6. The grievance of the petitioner is that the respondents 4 to 6 approached them and compelling to sell the said property for lower price to them, and also made a complaint before the 3rd respondent stating that the petitioner has encroached the said land. At the instance of the respondents 4 to 6, the 3rd respondent is calling the petitioner to the police station and compelling the petitioner to register the said land in the name of the respondents 4 to 6 for lower price, otherwise, false cases would be registered against the petitioner.
Learned Assistant Government Pleader for Home submitted that the respondent police are not intending to interfere with the civil disputes and also not compelling the petitioner to register the said land in favour of respondents 4 to 6.
Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:
" The 3rd respondent is directed not to interfere with the affairs of the petitioner and the respondents 4 to 6, more particularly, with the civil disputes pending between them. However, this Order will not stand in the way of the 3rd respondent to register a case, if any complaint is lodged against the petitioner for cognizable offence." There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ______________ RAJA ELANGO, J October 28, 2016 KTL
