THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2364 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/A-1 in Crime No.321 of 2015 of Humayungar Police Station, arising out of a private complaint for the offences punishable under Sections 406, 420, 500 and 506 IPC read with Section 34 IPC. Heard the learned counsel for the petitioner/accused No.1 and the learned Public Prosecutor and perused the material available on record.

Admittedly, a private complaint was filed by the 2nd respondent/de facto complainant before the concerned Magistrate and the same forwarded the same under Section 156 (3) Cr.P.C. to the Humayunnagar Police Station for investigation and report, on which the police registered the above crime for the alleged offences and the said crime was under investigation. Having regard to the facts and circumstances of the case and also in view of the nature of offences alleged against the petitioner, this Court is not inclined to interfere with the proceedings against the petitioner/accused No.1. However, in view of the submission of the learned counsel for the petitioner that the petitioner/accused No.1 is apprehending arrest in view of pendency of the above crime, the Humayunnagar Police are directed to complete the investigation without arresting the petitioner/accused No.1 and file the final report in accordance with law. The petitioner/accused No.1 is directed to appear before the Investigating Agency as and when his presence is required and

cooperate with the Investigating Agency.

With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
