2016-03-03M.S.Ramachandra Rao2 pages

THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.6698 of 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for respondents. 2.

Petitioners' grievance is that the petitioner had applied for survey of his agricultural land and had also paid the requisite fee on 19-11-2015 and had also made request on 28-01-2016 to 4th respondent to cause a survey done, but 4th respondent has not taken any action thereon. In these applications, they also sought for issuance of pattedar pass books and title deeds under the provisions of the AP Rights on Land and Pattedar Pass Books Act, 1971.

3.

Learned Government Pleader for Revenue appearing for respondents has placed before me the judgment of a Division Bench of this Court in W.A.No.110 of 2013 wherein this Court has held that there cannot be any prohibition to survey of private lands. Following this judgment, this Court in W.P.No.6690 of 2016 had allowed the said Writ Petition seeking a similar relief. 4.

Therefore, for the reasons alike, the present Writ Petition is also allowed and 4th respondent is directed to cause a survey of the land belonging to the petitioner on collecting of the requisite charges within eight weeks from the date of receipt of a copy of this order and thereafter also consider petitioner's request for grant of pattedar pass books and title deeds under the provisions of the AP Rights on Land and Pattedar Pass Books Act, 1971. No costs.

5.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
