Proof of service not filed. There is no appearance for the parties, when the matter is called today. It is noted that the postal article sent to the respondent is returned stating that the respondent is not available in the address.

However, the Family Court, Visakhapatnam, has reported that F.C.O.P.No.152 of 2017, which is now sought to transfer, is pending and after filing of counter-affidavit, the matter was referred to Mediation and the same is pending before the Mediation Centre and stands posted to 31.12.2018. 3.

In the light of the said situation, it is not appropriate now to consider transferring of that case.

Hence, this Transfer Civil Miscellaneous Petition is dismissed without prejudice.

Pending miscellaneous petitions, if any, shall also stand dismissed.
