THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.4929 of 2016 ORDER:

The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in Cr.No.22 of 2016 of Dharmavarm (Urban) P.S, Ananthapuramu District, registered for the offences punishable under sections 409 and 420 r/w.34 IPC.

Heard the learned counsel appearing for the petitioner/A5 and the learned Additional Public Prosecutor, representing the State. The petitioner herein has been confronted with similar complaints by different complainants alleging identical allegations, such as, Cr.No.25/2016 and 213/2016 of Dharmavaram (Urban) P.S., Anathapuramu District. Questioning his implication in the said crimes, the petitioner herein approached this Court by filing W.P.Nos.14973/2016 and 21050/2016, and this Court in exercise of powers under Article 226 of the Constitution of India, directed the investigating agency not to arrest the petitioner herein till completion of the investigation and filing of a final report and further directed that the petitioner shall cooperate with the investigating authorities and make himself available as and when required.

In view of the above, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation, however, without arresting the petitioner/A5 in the above crime, till the investigation is completed and the charge sheet is filed. The petitioner/A5 shall cooperate with the investigating agency and shall make himself available as and when required during course of investigation.

Pending miscellaneous applications, if any, shall stand closed in consequence.
