Heard both sides.

Perused the grounds urged in the transfer petition and other material on record filed by petitioner No.1-wife of the respondent to withdraw O.P.No.137 of 2017 from the file of the III Additional Senior Civil Judge, Kakinada, filed by her husband under Section 9 of the Hindu Marriage Act, 1955, for restitution of conjugal rights, to the file of the Judge, Family Court, Visakhapatnam, where the F.C.O.P.No.286 of 2017 filed by her for her maintenance and her daughter is pending.

Having regard to the above, the transfer C.M.P. is allowed and O.P.No.137 of 2017 pending on the file of the III Additional Senior Civil Judge, Kakinada, is withdrawn and transferred to the Judge, Family Court, Visakhapatnam, with a direction to post this matter and maintenance case F.C.O.P.No.286 of 2017 to same day, so that there will be convenience to the parties to appear. By virtue of this order, both parties are directed to appear before the Judge, Family Court, Visakhapatam, on 27.12.2017, without expecting any notice. Needless to say, the parties if at all representing through advocate permitted by the Court under Section 13 of the Family Courts Act, not to insist personal appearance, but for reconciliation and giving of

evidence, including in the maintenance case under Section 126(2) Cr.P.C.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
