BHANU AND THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI SPECIAL APPEAL No.9 OF 2003 JUDGMENT:(per Hon'ble Sri Justice K.C.Bhanu) This Special Appeal is filed by the appellant/dealer challenging the Order, dated 25.07.2002, in CCT's Ref.L.III(3)/541/2001-1, passed by the Commissioner of Commercial Taxes, Andhra Pradesh, Hyderabad.

3. It is represented by learned counsel for both the parties that this matter is squarely covered by a judgment of a Division Bench of this Court, dated 26.02.2015, rendered in Special Appeal No.31 of 2003.

Following the said order, this Special Appeal is allowed. Consequently, the impugned in this Special Appeal is set aside and the order of the Appellate Deputy Commissioner (Commercial Taxes), Kurnool, is confirmed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this appeal shall stand closed.
