HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.12566 of 2018 ORDER :

Heard the learned counsel for the petitioners/ accused persons in Cr.No.58 of 2017 of Chatrai Police Station, Krishna District registered for the offence punishable u/ sec.420IPC and also heard the learned Public Prosecutor representing the 2nd respondent before ordering notice to the 1st respondent and perused the grounds urged in the quash petition and the contents of the First Information Report.

Undisputedly the offence is with the punishment of not above 7 years, if at all any arrest of the petitioners/ accused persons is required, the police shall strictly follow Section 41-A of CrPC, and also the guidelines in Arnesh Kumar Vs. State of Bihar1. All available defences are left open to the petitioners. Having regard to the above, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
