CVNR, J CRP 5894/2017 ORDER:

This civil revision petition is filed against order dt.20.10.2017 in I.A. No.696 of 2017 in O.S. No.421 of 2006 on the file of the II Additional Senior Civil Judge, Visakhapatnam.

The petitioner filed the aforementioned I.A., under Order XVI Rule 14 of the Code of Civil Procedure, 1908 (CPC), for summoning the Superintendent of the Court of Revenue Divisional Officer (RDO), Visakhapatnam, to bring order dt.05.07.2008 in Appeal Case (RoR) No.1/2007/c, relating to Sy. No.24, Nidigattu Village, Bheemili Mandal, Visakhapatnam, and to give evidence before the Court. The application was dismissed mainly on the ground that the petitioner has not explained the relevancy for summoning the Superintendent along with the said document. Though the learned counsel for the petitioner sought to explain the relevancy, in my opinion, unless the petitioner has indicated in the pleadings the purpose for which the RDO is to be summoned and the relevancy of the document to be produced by him, the prayer sought for cannot be granted. Therefore, I do not find any jurisdictional error in the order of the lower Court in dismissing the application.

CVNR, J CRP 5894/2017 The civil revision petition is accordingly dismissed. As a sequel to dismissal of the civil revision petition, C.R.P.M.P.No.7616 of 2017 shall stand disposed of as infructuous.
