Common Order: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) W.P.Nos.42149 and 42184 of 2016 arise out of Common Order, dated 30-08-2013, in O.A.Nos.8464 and 8492 of 2012 respectively on the file of the Andhra Pradesh Administrative Tribunal at Hyderabad (for short 'the Tribunal').
W.P.No.25406 of 2017 arises out of Common Order, dated 28.04.2017, to the extent it pertains to OA.No.4544 of 2016 on the file of the Tribunal.
W.P.No.35632 of 2017 arises out of Common Order, dated 13.10.2017, to the extent it pertains to OA.No.2837 of 2017 on the file of the Tribunal.
The dispute raised in these Writ Petitions pertains to recruitment to the post of the Secondary Grade Teachers under DSC-1998 Notification concerning Krishna District. When the entire batch of Writ Petitions came up for hearing before this Court on 11.10.2017, this Court adjourned the cases to enable the learned Counsel appearing in the respective Writ Petitions to file tabular statements showing the category wise marks obtained by the petitioners vis-à-vis
the selected candidates, by making it clear that, if any of the learned Counsel does not prepare such tabular statements, it will be presumed that the petitioners therein have not secured more marks than the selected candidates, who are appointed as teachers.
On 25-10-2017, by a detailed Common Order, we have disposed of W.P.Nos.12452 of 2013 and batch filed raising the same dispute concerning East Godavari and Prakasam Districts as raised in these Writ Petitions. We have held therein that the plea of the petitioners that they secured higher marks than the selected candidates in their respective categories is factually incorrect. As regards these Writ Petitions, which arise from Krishna District, the learned Counsel appearing in these cases has not prepared the tabular statements despite giving him an opportunity by adjourning the cases. Therefore, as per Order, dated 11.10.2017, it is reasonable to presume that the petitioners herein have not secured more marks than the selected candidates, who are appointed as teachers. Hence, these Writ Petitions are dismissed.
As a sequel to dismissal of the Writ Petitions, pending Miscellaneous Petitions, if any, shall stand dismissed as infructuous.
