THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI CIVIL REVISION PETITION No.6084 of 2017 ORDER:

This civil revision petition, under Article 227 of the Constitution of India, is filed by the unsuccessful plaintiff assailing the order, dated 20.07.2017, of the learned Junior Civil Judge, Nidamanoor, passed in I.A.No.153 of 2017 in O.S.No.12 of 2015. 2.

I have heard the submissions of Smt Annapurna Sreeram, learned counsel appearing for the revision petitioner/plaintiff, and of Sri A.Ananthasen Reddy, learned counsel appearing for the respondents/defendants. I have perused the material record. 3.

At the hearing, learned counsel for the parties stated that the parties entered into a compromise and that the settlement has to be reported to the trial Court and, therefore, the revision petition may be allowed and the impugned order, whereby the above stated interlocutory application, which is filed to set aside the order of dismissal of the suit for default and restore the suit to file was dismissed, may be set aside and the said application may be allowed and the suit may be restored to file to enable the parties to go before the trial Court and report compromise and have the matter settled.

Recording the submissions, without going into the merits of the matter and on consent of the learned counsel for both parties, this Civil Revision Petition is allowed and the impugned order, dated 20.07.2017, is set aside and as a sequel, I.A.No.153 of 2017 in O.S.No.12 of 2015, on the file of the learned Junior Civil Judge, at Nidamanoor, is allowed and the original suit is restored to file.

Pending miscellaneous petitions, if any, shall stand closed in MSRM, J C.R.P.No.6084 of 2017 the light of this final order.

There shall be no order as to costs.
