Heard learned counsel for the petitioners, learned Government Pleader for Municipal Administration and Sri S.D.Gowd, learned Standing counsel for respondent No. 2. 2.

Petitioners claim to be running small business on either side of Prakasam High Road i.e., New Collectorate to Venkusa Kalyanamandapam to the existing 50" Road and some of the petitioners are also having dwelling houses and running petty business to eke out their livelihood. Petitioners allege that the respondents proposed to widen the existing 50 feet road of Prakasam high road to 100 feet without following the due process. Hence, this writ petition.

Learned Standing counsel, on instructions, informs the Court that as of now, no proposals are taken up for widening of the road and as and when a decision is made to widen the road, and the private properties are likely to be affected, due process will be followed before displacing the persons. 4.

In view of the said statement of learned Standing counsel, the Writ petition is disposed of directing the respondents to follow due process as required by law, before utilizing the properties belonging to petitioners for public purpose, subject to verification of ownership claims and the nature of business

- 3 - carried out by them. Pending miscellaneous petitions shall stand closed.
