THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.4475 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a Writ order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not appointing the petitioner on compassionate grounds in a suitable post in the respondent organisation as the petitioner's husband died on 02-01-2013 due to hemorrhagic stroke is arbitrary, illegal and against the principles of natural justice and consequently direct the respondents to appoint the petitioner on any suitable post on compassionate grounds by considering the representations dt.17-092013 and 04-12-2013 and to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

2. Heard Sri D.L.Pandu, learned counsel, appearing for the petitioner and learned counsel appearing for the respondents.

3. According to the petitioner, her husband Sri N.Shivanand, passed away on 02.01.2013, while he was on duty in the office of the 2nd respondent, due to hemorrhagic stroke. It is further stated that she made a representation on 04.12.2013, requesting respondents herein for consideration of her case for appointment on compassionate grounds and no action has been taken so far. It is requested by the learned counsel for petitioner that the representation dated 04.12.2013 pending before the respondent may be directed to be disposed of by fixing some timeframe. This Court considers the said request as reasonable.

4. For the aforesaid reasons, Writ Petition is disposed of, directing

the respondents to pass appropriate orders on the representation dated 04.12.2013, said to have been submitted by the petitioner herein, within a period of two months from the date of receipt of a copy of this order.

5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 23.02.2016 SS
