HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 3166 of 2016 ORDER:
The order dated 16.01.2015 impugned in the writ petition is passed by the Revenue Divisional Officer, Amalapuram, 3rd respondent herein, under Rule 8 of the Rules framed under the A.P. Agricultural Land (Conversion for NonAgricultural Purposes) Act, 2006 (for short 'the Act'). The said order is referable to Section 6 of the Act, as the petitioner is found to have converted the agricultural land to non-agricultural purpose without obtaining the requisite permission. Though the petitioner raised several grounds against the impugned order, under Section 8 of the Act, he has a remedy of preferring an appeal before the District Collector within 60 days from the date of receipt of the order. But, without availing the appellate remedy within the stipulated time, the petitioner filed the writ petition. Hence, I do not see any reason to entertain the writ petition.
Accordingly, the Writ Petition is dismissed. However, in the circumstances, liberty is given to the petitioner to prefer an appeal before the appellate authority within one week from the date of receipt of a copy of this order. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand dismissed.
