HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY CIVIL REVISION PETITION No.5633 OF 2017 O R D E R :

This Civil Revision Petition is filed against the order dated 22.09.2017, passed in IA.No.964/2017 in OS.No.18/2011 by the Senior Civil Judge, Narsapuram, which was filed by the petitioner for sending the Registered Settlement Deed dated 28.06.2010 vide document No.3926/2010 executed by the 1st petitioner, to the impounding authority for collection of stamp duty and penalty. Heard learned counsel for the petitioner.

Petitioner wants to rely on the said document to prove their title which cannot be admitted into evidence, since the document pertains to transfer of rights in the property with possession, it certainly requires registration and even if it is impounded the petitioners can not rely on the same. Petitioners are claiming adverse possession and they can prove the same by way of any mode of evidence. The Court below also observed the same. Since the purpose for which petitioner wants to rely is not for collateral purpose, I do not see any infirmity in the order passed by the Court below. Accordingly, the Civil Revision Petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending shall stand closed.
