HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CIVIL REVISION PETITON No.5739 OF 2016 ORDER:

This Civil Revision Petition is filed against the docket order 08-11-2016, wherein the trial Court dismissed the application filed by the petitioners for reopening the matter for further evidence.

Heard learned counsel for the petitioners.

It is to be seen that the petitioners evidence was closed on 04-08-2015 only after the matter was adjourned for five times and the petition was filed after lapse of two months thereafter and the trial Court after referring to the same by observing that there are no bonafides on the part of the petitioners and dismissed the application. The trial Court also found that the suit is of the year 2010 and six years have been elapsed, still the petitioners/defendants intend to protract the proceedings on one or other pretext. It is also observed that the suit is identified one. A perusal of the impugned order goes to show that application of the petitioners was considered and found that it is not bonafide one and the petitioners are not willing to proceed with such further defence evidence. In view of the same, I do not see any infirmity in the order passed by the trial Court.

Accordingly, the Civil Revision Petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 22-11-2016 nvl
