HON'BLE SRI JUSTICE S.V. BHATT C.R.P. No. 6336 OF 2017 ORDER:

Heard Mr.Prashanth for petitioner and Mr.Ravi Kiran Rao for respondents 1 to 5.

On 17.11.2017, this Court ordered notice to respondents and in the meantime, directed the parties not to change the physical features or cause obstruction in the existing roads for a period of one week.

The C.R.P. is directed against the urgent notice ordered by the III Additional District Judge at Karimnagar in I.A. No.648 of 2017. The prayer for ad-interim injunction/ temporary injunction is pending consideration by the trial Court.

The C.R.P. is disposed of by this order:

a) It is made clear that either in the order dated 17.11.2017 or by the present order, it shall not be understood that this Court has examined the merits in the rival claims of the parties.

b) The trial Court as and when takes up I.A.No.648 of 2017 for enquiry and disposal, is to independently consider and dispose of the application.

c ) The trial Court considers and disposes of I.A.No.648 of 2017 within two weeks from the date on which the counters of respondents 1 to 5 are filed.

d) The parties are directed to continue to maintain order granted on 17.11.2017 for a period of four weeks from today.

e) The trial Court makes all efforts to dispose of the application within the time stipulated by this Court. No order as to costs.
