HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 2 6 0 4 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Station House Officer, Golconda Police Station, Hyderabad, dated 26.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "At the outset, it is submitted that the Golkonda Police are not calling the petitioners and their relatives to the Police Station. It is submitted that as of now there is no complaint received or crime registered against the petitioners herein. Hence, the question of calling the petitioners to the Police Station does not arise. The Golconda Police are not calling the petitioners and their relatives and not harassing them as alleged in the affidavit.
In reply to para 13 of the affidavit, it is submitted that the 1st petitioner has not approached the Police Station and not given any report. It is false to state that the 1st petitioner requested to find out the whereabouts of the 2nd petitioner and take cognizance against the culprits as per law, and lastly when the Police came in action, the accused released the 2nd respondent and now threatening him with dire consequences. In reply to para 15, it is submitted that it is denied that the 6th respondent is continuously calling the petitioners to the Police Station. It is false to state that the culprits are using the phones of the Police and contacting the relatives of the petitioners. It is not correct to state that the 6th respondent is taking personal interest in the matter. The further allegation that due to the act of
the 6th respondent and his staff, the petitioners are unable to lodge complaint against the wrong doers is totally false, baseless and hereby denied.
It is submitted that, as stated above, the Golconda Police much less the 6th respondent are not calling the petitioners. The allegations made in the affidavit are not correct and hereby denied." Accordingly, by placing on record the said instructions, the Writ Petition stands disposed of, with a further direction to the respondent-Police authorities to act strictly, in accordance with law.
