THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITON No.34448 of 2017 O R D E R:
The issue relates to payment of life insurance amount upon demise of late Veeranjaneyulu.
Mr. Bathula Raj Kiran, appearing for respondents 1 and 2 submits that the Life Insurance Corporation is governed by nomination of details given by the policy holder. If there is a nomination, the Corporation will not go into other aspects unless there are orders from competent civil court. In the case on hand, he submits that the insurance company cannot examine the claim of petitioners on one hand and 3rd respondent on the other hand, but, still act in that matter as per the nomination given by the deceased. This Court is of the view that the disputes, if any, between the petitioners and the 3rd respondent have to be worked out before the competent court. This court cannot issue direction to respondents 1 and 2 contrary to the nomination or direct them to consider and dispose of representation filed by the petitioners. Grievances now canvassed by the petitioners are to be properly pleaded and proved before the competent court. By granting such liberty, this writ petition is dismissed. No order as to costs.
Miscellaneous petitions if any, pending in this writ petition shall stand closed.
