HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 2 7 0 3 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Station House Officer, Kotpally Police Station, Vikarabad District, dated 26.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that the petitioner has given a petition with Kotepally Police Station, Vikarabad District alleging that one Syed Suleman Hashmi, S/ o.Syed Abdul Bari, R/ o.6-91, Near Jama Masjid, Kotpally village, Vikarabad District, and presently residing at H.No.8-7-39/ 4B, Momin Galli, Old Tandu is harassing, giving lot of difficulties, disturbing, blaming, doing illegal and criminal activities, unauthorizedly performing marriages and the said person also damaging his name and reputation.
The petitioner requested to take action against him. It is submitted that based on the contents of the report, a GD entry was made in the Station records and conducted enquiry. As per the report of the petitioner, the alleged person is unauthorizedly performing marriages and damaging the name and reputation of the petitioner.
It is submitted that the enquiry revealed that the subject matter of the Writ Petition/ report given by the petitioner, it is a Quazi's matter, which is civil in nature and police cannot interfere with the same. It is submitted that after enquiry, the petitioner was informed that police cannot interfere in civil matters and he may approach the concerned authority/ Court. After enquiry, a notice dated 16.11.2018 was also
given to the petitioner under acknowledgment. Inspite of informing the petitioner that the police cannot interfere in civil matters, the petitioner filed the present Writ Petition alleging that the police have not taken any action on his report.
It is submitted that, as stated above, police have already taken action on the petitioner's report duly conducting enquiry and informing that the subject matter is civil in nature and police cannot interfere with the same."
Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Station House Officer, Kotpally Police Station, Vikarabad District, dated 26.11.2018. However, it is open for the petitioner herein to avail the other remedies available to him, in accordance with law.
