Sripuram Bujjamma, v. The State Of Andhra Pradesh,

2018-12-11A.Rajasheker Reddy1 pages

THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.42693 OF 2018

O R D E R

The case of the petitioners is that they are the landless poor persons within the definition of Board Standing Order 15 (10) and that they made number of representations and the latest one was made on 19.11.2018 seeking for allotment of land. Their grievance is that the official respondents 3 and 4, ignoring their application, are taking steps to assign the subject land to unofficial respondents 5 and 6, who are ineligible. Hence, the present writ petition. Heard the learned counsel for the petitioners. Learned Assistant Government Pleader for Revenue produced written instructions of the 4th respondent - Tahsildar, in Rc.B.568/2018 dated 27.11.2018.

In this case it is to be seen that it is for the competent authority to consider the application of the petitioners and unofficial respondents 5 and 6, along with other eligible persons, for making allotment in accordance with law and this court under the writ jurisdiction, cannot conduct a roving inquiry into the eligibility or otherwise of the beneficiaries and further, as on today no allotment is made. In view of the same, the writ petition is devoid of any merit and the same is accordingly dismissed.

Interlocutory applications pending, if any, shall stand closed. No costs. ------------------------------------------ A.RAJASHEKER REDDY,J DATE: 11-12-2018 avs
