THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.44141 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of respondents 2 to 4 in not considering the representation/ legal notice dated 25.10.2016 of the petitioners and not taking action by conducting enquiry on the irregularities committed by the President and other Directors of 5th respondent-society as illegal and arbitrary.

Heard the learned counsel for the petitioners and the learned Government Pleader for Co.operative Societies, representing respondents 1 to 4 and the learned counsel for 5th respondent. 3.

A perusal of the record reveals that the petitioners submitted a representation on 25.10.2016 to respondents 2 to 4. For one reason or other, respondents 2 to 4 did not dispose of the representation of the petitioners.

At the time of arguments, the only relief sought by the learned counsel for the petitioners is to direct the respondents 2 to 4 to dispose of the representation of the petitioners dated 25.10.2016.

In view of the submission made by the learned counsel for the petitioners, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, respondents 2 to 4 are hereby directed to dispose of the

representation/legal notice of the petitioners dated 25.10.2016 in the light of the provisions of A.P.Co-operative Societies Act and Rules made there under as expeditiously as possible, preferably, within a period of three months from the date of receipt of copy of this order.

With the above direction, writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
