Aggrieved by the proceedings of the 2nd respondent - Commissioner, in Lr.No.A7/2308/ESD/2015 dated 12.10.2018 in blacklisting the petitioner , who is the operator of Aadhar Centre with Opr.ID:S_TSO_SDPT_001, and in imposing penalty of Rs.50,000/-, the present writ petition is filed. Learned counsel for the petitioner mainly contended that before blacklisting and imposing penalty, petitioner was not issued with any notice giving opportunity.

Learned Assistant Government Pleader for General Administration Department, produced written instructions of the 2nd respondent. In the said written instructions, the plea taken by the petitioner with regard to violation of principles of natural justice, has not been adverted to. The grievance of the petitioner is that before passing the impugned proceedings, he was not issued with any notice. Impugned proceedings also do not indicate that before blacklist and imposing penalty, petitioner was issued with any notice. Therefore, on the ground of violation of principles of natural justice, impugned proceedings to the extent of writ petitioner are set aside. However, it is open to the respondents to take appropriate action in accordance with law, after issuing notice and opportunity of hearing to the petitioner. Writ petition is accordingly allowed to the extent indicated above. Interlocutory applications pending, if any, shall stand closed.
