HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.30126 of 2016 ORDER:

This writ petition is filed challenging the impugned letter No.C/9279, dated 30-08-2016 addressed by the Sub-Collector, Jagtial to the Sub-Divisional Police Officer (S.D.P.O.), Jagtial stating that the petitioner has committed some irregularities and criminal case is to be registered.

Learned counsel for the petitioner submits that the letter is very vague and no departmental proceedings are initiated against the petitioner as of now. As such, without initiating disciplinary proceedings and without issuing any show-cause notice, the Sub-Collector could not have addressed letter to the S.D.P.O. for registering the crime.

Learned Standing Counsel for Housing Board says that the petitioner and others made irregular allotment of houses. As such, letter addressed to register the criminal case. This is all internal correspondence from the SubCollector to the S.D.P.O., it is for the S.D.P.O. to consider the same and take action.

As on today, no crime is registered against the petitioner. Before registering the criminal case, it is not required that departmental proceedings should be

initiated. As and when any crime is detected, it is for the police to take action in accordance with law. No showcause notice is required to be issued before registering the crime.

In view of the same, I do not see any merit in the writ petition.

Accordingly, the writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 09-09-2016 nvl
