HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No. 19705 of 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This writ petition is directed against the order, dated 18.03.2016, passed by Lokayukta. While dismissing the complaint made by the petitioner, the Lokayukta has observed that the complaint is malicious and also vexatious, and facts and circumstances warrant imposition of costs against the petitioner and quantified it at Rs.10,000/- payable to respondent No.4.

Respondent No.4 was granted freedom fighters pension more than 30 years ago for his participation in the freedom struggle. He was detained in jail. All these facts are examined by the Lokayukta in detail in the light of the grounds of challenge. Mr.M.Sudheer Kumar, learned counsel for the petitioner, invited our attention to only one document i.e. separate sheet for Column No.13 on page 74 of the paper book to contend that he was not detained in connection with the freedom struggle. This contention was also raised before Lokayukta and after considering the same on merits, it was rejected.

In our opinion, Lokayukta has rightly dismissed the complaint as malicious and vexatious. We are informed that the petitioner is an Advocate and his wife is Junior of respondent No.4 and there was

matrimonial litigation, which was contested by respondent No.4 on behalf of his wife and succeeded in all proceedings. Keeping that in view and having considered the reasons recorded by Lokayukta, we are not inclined to interfere with the order impugned in the present writ petition.

Writ petition is dismissed.

Consequently, miscellaneous petitions, if any, also stand disposed of.
