HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD CRIMINAL REVISION CASE No.3228 of 2018 ORDER :

This Criminal Revision Case is arising out of the order dated 23.10.2018 in Crl.MP.No.198 of 2018 in FCOP.No.308 of 2018 passed by the learned Judge, Family Court-cum-XII Additional District Judge, Guntur (Family Court). Heard learned counsel for the petitioner/respondent and perused the material on record.

The petitioner is husband of respondent No.1 and father of respondent Nos.2 to 4 herein. Respondent Nos.1 to 4 herein have filed FCOP.No.308 of 2018 seeking maintenance @ Rs.10,000/- per month each. Along with the O.P., they also filed a petition under Section 125 of Cr.P.C., in Crl.MP.No.198 of 2018 seeking interim maintenance of Rs.10,000/- per month each, thus totalling to Rs.40,000/-. On consideration of the material on record, vide impugned order dated 23.10.2018, the Family Court has directed the petitioner to pay interim maintenance @ Rs.3,000/- per month each during the pendency of the FCOP. Aggrieved by the same, the petitioner has filed the present revision seeking to reduce the interim maintenance granted by the Family Court.

GSP,J Crl.RC.No.3228 of 2018 Ordinarily, this Court would not interfere in the interim orders passed by the trial Courts during the pendency of main cases.

In view of the facts and circumstances of the case and in view of the submission made by the learned counsel that the petitioner is working as a News Reader and the means of the petitioner and respondent No.1 is also in dispute, since interim maintenance ordered by the Family Court is only on the basis of assumption, the interim maintenance of Rs.3,000/- per month each granted by the Family Court is reduced to Rs.2,500/- per month each, payable on or before 10th of every succeeding month. The Family Court is directed to dispose of the FCOP, expeditiously.

With the above observations, this Criminal Revision Case is disposed of.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
