Inspite of service of notice, there is no representation on behalf of the respondents.

The present application came to be filed by the petitioners questioning the order dated 12.06.2017 passed in E.P.No. 5 of 2017 in O.S.No. 471 of 2015, on the file of the First Additional Senior Civil Judge, Kakinada, East Godavari district. 3.

When the matter is taken up today, it is brought to the notice of this Court that the petitioners herein have filed an application before the trial court to set aside the ex parte decree dated 23.12.2015 in O.S.No. 471 of 2015 and the same is pending consideration.

Having regard to the above, this C.R.P is disposed of, directing the trial court to dispose of the application, if any, filed by the petitioners seeking to set aside the ex parte decree passed in O.S.No. 471 of 2015 and also I.As, if any, filed in the said application, as early as possible, preferably, within a period of three to six months. Miscellaneous petitions pending, if any, shall stand closed. No costs.
