THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37853 OF 2016 ORDER:

This Writ Petition is filed seeking to declare the action of respondent No.2 in not conducting survey and fixing boundaries in respect of the land admeasuring Ac.0-34 guntas in Survey No.5/AA, Raidurg Khalsa, Serilingampally Mandal, Ranga Reddy District, belonging to the petitioner, having received the application and requisite fee on 19.02.2016, as illegal and arbitrary.

2. Learned counsel for the petitioner and the learned Government Pleader for Revenue would submit that the subject matter of this Writ Petition is squarely covered by the judgment of this Court in W.P.No.4811 of 2011 and batch, dated 28.04.2016.

3. Following the same, this Writ Petition is also disposed of with the following direction:

"The respondent - authorities are directed to consider the application of the petitioner for survey of the subject land after receiving necessary charges, keeping in view the Circulars vide Rc.No.N1/1408/07, dated 13-07-2007, Rc.No.N1/6543/99, dated 25-07-2001, and Rc.No.N2/1741/2010, dated 18-05-2010, and also in terms of the judgment in W.A.No.618 of 2013 and also keeping in view the provisions of Sections 89, 89-A and 92 of the Andhra Pradesh (Telangana Area) Land Revenue Act, 1317 Fasli, and take necessary action and communicate the decision to the petitioner. It is open for the petitioner to prefer

CPK,J W.P.No.37853 of 2016 appeal against the said order, if he is aggrieved, in terms of circulars referred to above."
